These Terms of Service ("Terms") govern your access to and use of Propieda ("we," "us," "our"), a property information platform for Puerto Rico. By accessing or using Propieda, you agree to be bound by these Terms.

1. Platform Services

1.1 What We Provide

Propieda provides:

• Access to public property and parcel data
• Property information aggregation and display
• Free property claiming and verification services
• Optional paid AI-powered location intelligence reports
• Tools for property owners to create listings
• Communication tools for buyers and sellers
• Community forums and discussion boards

1.2 What We Are Not

• Not a Real Estate Broker: We do not facilitate transactions, hold escrow, or provide brokerage services
• Not Legal or Financial Advisors: We do not provide legal, tax, or investment advice
• Not Title Insurance: We do not guarantee property ownership or title status
• Not Government Entity: We are not affiliated with any government agency

2. Data Accuracy & Disclaimers

2.1 Property Data Sources

Property data is sourced from publicly available government records, third-party data providers, and user-submitted information. Propieda aggregates and processes data from various sources to create our property database.

Data Accuracy Disclaimer: While we strive for accuracy in our data collection and processing:

• Data may be outdated, incomplete, or contain errors from source systems
• Parcel boundaries are approximate and for informational purposes only
• Area calculations may not reflect current surveys
• We update data periodically but cannot guarantee real-time accuracy
• Government databases may contain inconsistencies or outdated information

Your Use of Our Data: The data we provide is for informational purposes only. You may not:

• Republish, redistribute, or resell our processed data without permission
• Use automated tools to extract or scrape data from Propieda
• Create derivative databases using our data without authorization
• Access our APIs or services through unauthorized means

2.2 AI-Generated Content

Our Location Intelligence reports use artificial intelligence (GPT-4 and similar models):

• Not Investment Advice: Reports are informational only and should not be relied upon for investment decisions
• AI Limitations: AI may generate inaccurate, incomplete, or biased information
• No Guarantee: Scores, assessments, and recommendations are estimates only
• Verify Independently: Always conduct your own due diligence with licensed professionals

2.3 User-Generated Content

Property listings, descriptions, photos, and forum posts are created by users:

• We do not verify accuracy of user-provided information
• Prices, descriptions, and photos may be inaccurate or misleading
• Users are responsible for the content they post
• We moderate content but cannot guarantee its accuracy

3. User Accounts & Registration

3.1 Account Creation

To use certain features, you must create an account. You agree to:

• Provide accurate, current, and complete information
• Maintain the security of your account credentials
• Notify us immediately of unauthorized access
• Be responsible for all activity under your account
• Not share your account with others

3.2 Eligibility

You must be at least 18 years old to use Propieda. By using the platform, you represent that you meet this requirement.

4. Property Claims & Verification

4.1 Claiming Process

Users may claim properties by providing evidence of ownership. By submitting a claim, you represent and warrant that:

• You are the legal owner or authorized representative of the property
• All information and documents provided are accurate and authentic
• You have the right to list and market the property
• You will not make false or misleading claims

4.2 Verification Limitations

Our verification process reviews submitted documents but:

• Does not constitute a title search or legal validation
• Cannot guarantee authenticity of submitted documents
• May be subject to errors or oversights
• Does not create any legal rights or obligations

4.3 False Claims

Submitting false ownership claims is prohibited and may result in:

• Immediate account termination
• Removal of all claims and listings
• Reporting to law enforcement if fraud is suspected
• Legal action for damages

5. Paid Services & Billing

5.1 Pro Subscription

Pro subscriptions ($10/month) provide research credits and enhanced features:

• Billed monthly in advance
• Auto-renewal unless cancelled
• Cancel anytime through your account settings
• No refunds for partial months
• Credits expire at end of subscription period

5.2 One-Time Purchases

Location Intelligence reports can be purchased individually:

• All sales are final (digital goods)
• Reports generated instantly upon payment
• No refunds after report is generated
• Prices subject to change without notice

5.3 Payment Processing

Payments are processed through third-party providers (Stripe). By making a purchase, you agree to their terms.

6. User Content & Conduct

6.1 Content You Post

You may post:

• Property listings and descriptions
• Photos and media
• Comments and forum posts
• Offers and messages

6.2 Content License

By posting content, you grant Propieda a worldwide, non-exclusive, royalty-free license to use, display, reproduce, and distribute your content in connection with operating the platform.

6.3 Prohibited Content

You may not post content that:

• Violates any law or regulation
• Infringes intellectual property rights
• Contains false or misleading information
• Is defamatory, harassing, or abusive
• Contains viruses or malicious code
• Violates privacy or publicity rights

7. Bitcoin & Cryptocurrency

Some listings display Bitcoin pricing as an optional feature:

• Display Only: Bitcoin prices are for reference and may not reflect current rates
• No Payment Processing: We do not process Bitcoin transactions
• High Volatility: Cryptocurrency prices fluctuate significantly
• Tax Implications: Consult a tax professional regarding crypto transactions
• Regulatory Risk: Cryptocurrency regulations vary and may change

8. Intellectual Property

All platform content, including design, code, logos, and text, is owned by Propieda or our licensors and protected by copyright and trademark laws.

You may not:

• Copy, modify, or distribute platform content without permission
• Use our trademarks or branding without written consent
• Scrape or extract data through automated means
• Reverse engineer or decompile any platform code
• Access our APIs or backend services without proper authorization
• Circumvent any security measures or rate limits
• Use our services to create competing platforms or databases

8.2 API Access & Security

Our APIs and backend services are intended solely for use by our official Propieda applications and authorized partners:

• No Unauthorized API Access: You may not access our APIs through third-party applications, scripts, or tools
• Rate Limiting: We implement rate limiting to protect our infrastructure. Excessive requests may result in temporary or permanent blocking
• Authentication Required: All API access requires proper authentication and session management
• Security Measures: We employ origin validation, CORS policies, and other security measures to prevent unauthorized access
• Monitoring & Enforcement: We actively monitor API usage and will block suspicious or abusive traffic

Consequences of Unauthorized Access: Attempting to access our APIs or services through unauthorized means may result in:

• Immediate IP blocking and account termination
• Legal action for computer fraud and abuse
• Reporting to law enforcement authorities
• Civil damages for any harm caused to our systems or business

9. Disclaimer of Warranties

We disclaim all warranties, including:

• Accuracy, completeness, or reliability of information
• Availability or uninterrupted access to the platform
• Security of data or communications
• Fitness for any particular purpose
• Results from using the platform

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, PROPIEDA SHALL NOT BE LIABLE FOR:

• Any indirect, incidental, special, or consequential damages
• Loss of profits, data, or business opportunities
• Damages resulting from errors in property data
• Failed transactions or disputes between users
• Reliance on AI-generated reports or information
• Unauthorized access to your account

Our total liability shall not exceed the amount you paid to Propieda in the 12 months preceding the claim, or $100, whichever is greater.

11. Indemnification

You agree to indemnify and hold Propieda harmless from any claims, damages, or expenses arising from:

• Your use of the platform
• Your violation of these Terms
• Content you post or submit
• False ownership claims
• Disputes with other users

12. Termination

We may suspend or terminate your account at any time for:

• Violation of these Terms
• Fraudulent or illegal activity
• False ownership claims
• Abusive behavior toward other users
• Any reason at our sole discretion

You may terminate your account at any time through account settings. Termination does not entitle you to refunds for unused subscription time or credits.

13. Governing Law & Disputes

These Terms are governed by the laws of Puerto Rico and the United States, without regard to conflict of law principles.

Any disputes shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association, except for claims seeking injunctive relief.

14. Changes to These Terms

We may update these Terms from time to time. Material changes will be announced via email or platform notification. Continued use of Propieda after changes constitutes acceptance of the new Terms.
